MONTREAL CONVENTION

DELAY OF PASSENGER

LIABILITIES OF THE AIR CARRIER:

Under the terms of the Montreal Convention, the air carrier is liable for the damage caused by the delays of air carriage of passengers.

EXTENT OF COMPENSATION FOR DAMAGE

In the case of damage caused in the transportation of people, the liability of the carrier is limited to 5.346 SDR (approximately 731.717,00 CVE) per passenger.

DEATH AND BODYLY INJURY OF PASSENGER

LIABILITY OF THE AIR CARRIER:

Under the terms of the Montreal Convention, the carrier is liable for the damage sustained in case of death or bodily injury of a passenger, upon condition only that the accident which caused the death or the bodily injury took place on board of the aircraft or in the course of any operation of embarking or disembarking.

EXTENT OF COMPENSATION FOR DAMAGE

The passenger is entitled to indemnification reaching up to the limit of 128.821 SDR (17.631.000,00 CVE) per passenger, in case of death or bodily injury and this value shall not be excluded or limited.

People entitled to claim compensation in case of death or bodily injury, may without delay receive advance payments to satisfy, economically, their immediate needs. Such advance payments shall not constitute a recognition of liability and may be offset any amounts subsequently paid as damages by the carrier.
